The Danish Folks Party (extreme right wingers) today proclaimed that they now support a heroin trial in Denmark, and that they therefore will launch a new heroin trial proposal when the parliament gathers next week at the 3^rd. of October.

Our current right wing government coalition has a long history of being against a Danish heroin trial. In January three parties from the opposition raised a proposal of a Danish heroin trial but they still needed more support to win progress. Now with the Danish Folks Party there is a majority. I and many with me would love to see that the right wingers lost their government power on the subject, but that is not very likely. I do not expect that our government will risk ending up, as a minority on the subject. So probably they will change their historical opinion against very soon. Actually our minister of health opened a cat flap for a heroin trial in June, but to stall things he said that he would like to wait to take a final decision until he had seen a report from a combined methadone/heroin trial in U.K. that should be ready sometime in 2008. Now he’s probably forced to speed up his decision if he wants to keep his minister post and the government wants to continue to be in charge. Indeed a very exiting situation – we keep our breath and really look forward to read the entire proposal text next week.

150 kilo onderschepte heroïne verdwenen

DEN HAAG (GPD) - Ruim 150 kilo heroïne die de afgelopen jaren door de Nederlandse politie is onderschept, blijkt spoorloos te zijn verdwenen. De verdovende middelen hadden vernietigd moeten worden.

Processen-verbaal wijzen uit dat dit niet of niet geheel is gebeurd. Dat blijkt uit onderzoek van het televisieprogramma Nova.

Onderschepte partijen verdovende middelen moeten worden vernietigd in een afvalverbrander onder toezicht van rechercheurs. Zij moeten daarvan vervolgens proces-verbaal opmaken.

In drie politieonderzoeken tegen Turkse heroïnehandelaars blijken die processen-verbaal er niet te zijn of niet te kloppen. Het gaat om onderzoeken van het team Amsterdam-Noord van de Nationale Recherche. De straatwaarde van de verdwenen drugs loopt in de miljoenen.

Uit processen-verbaal in de desbetreffende dossiers blijkt dat de ter vernietiging aangeboden hoeveelheid heroïne steeds afwijkt van de daadwerkelijk vernietigde heroïne. Het gaat om partijen van 69,7 kilo waarvan 29,7 kilo niet is vernietigd, om 204 kilo waarvan 21,5 kilo niet is vernietigd en om 99,2 kilo die helemaal niet is vernietigd.

Volgens de Nijmeegse strafrechtdeskundige Ybo Buruma tonen de dossiers aan dat er 'iets hartstikke fouts aan de hand is'. ,,Of het Openbaar Ministerie weet wat er aan de hand is en dan hebben we natuurlijk een schandaal van de eerste orde. Of het OM weet niet wat er hier aan het gebeuren is, en dat is dan het bewijs dat het systeem niet goed in elkaar zit."

Behalve het verdwijnen van partijen heroïne, is er volgens Buruma ook sprake van het doorlaten van drugs. Zo liet de politie in één van de onderzochte zaken een kleine partij van 4,5 kilo de markt op verdwijnen om een paar weken later een grote partij van 204 kilo in beslag te kunnen nemen.

Deze opsporingsmethode is verboden sinds het parlementair onderzoek door de commissie Van Traa naar de IRT-affaire. Die commissie concludeerde in 1996 dat politie en justitie vrij spel hadden in hun strijd tegen de georganiseerde criminaliteit en dat dat tot uitwassen had geleid. De zaak kwam aan het rollen doordat rechercheurs van het interregionaal rechercheteam Noord-Holland/Utrecht bewust partijen drugs doorlieten om op deze manier in misdaadbendes te infiltreren.

Het Landelijk Parket, dat de Nationale Recherche aanstuurt, laat weten niet aan te kunnen tonen dat de verdwenen heroïne daadwerkelijk is vernietigd, maar zegt daar wel op te vertrouwen. In één geval zou de weegapparatuur van het afvalverwerkingsbedrijf waar de heroïne onder toezicht werd verbrand niet goed hebben gefunctioneerd. Het Landelijk Parket ontkent dat de Nationale Recherche drugs heeft doorgelaten.

DEATH PENALTY: FOUR MORE DRUG OFFENDERS SENTENCED TO DEATH IN VIETNAM, 17 HUNG IN IRAN

Four more people have been sentenced to death for drug trafficking offenses in Vietnam in the past week. Meanwhile, Iran reported that it had executed 17 drug traffickers earlier this month.

Under Vietnamese law, anyone convicted of possessing or trafficking more than 600 grams (about 1 ¼ pounds) of heroin or 44 pounds of opium is eligible for the death penalty. Under Iranian law drug trafficking is one of numerous offenses that can garner the death penalty.

In Hanoi People's Court on September 14, three members of the same extended family were sentenced to death for trafficking four pounds of heroin. Two other members of the organization received life sentences, while four others received sentences ranging from 10 months to 20 years. All were convicted of bringing heroin from northern mountainous Son La province to Hanoi between June and August of 2006.

On Tuesday, the Ho Chi Minh City People's Court announced it had sentenced a 40-year-old Australian citizen to death for heroin trafficking. Nguyen Hong Viet was arrested at the Ho Chi Minh City airport with nearly 950 grams of heroin in his clothing as he waited to board a flight to Sydney. Viet told police he was paid $10,000 to carry the drugs to Australia.

"Prosecutors find that with the amount of heroin trafficked, the defendant deserved the highest and most severe punishment so that society can prevent this crime and have educational impact on others," the Ho Chi Minh City People's Court said in a statement.

Viet is one of at least five Australians of Vietnamese descent who have been sentenced to death for drug trafficking in Vietnam. None have yet been executed.

Meanwhile, Iranian state television tersely announced another round of executions. "After legal procedures, 17 individuals were hanged on the charges of drug smuggling in Khorasan Razavi province this morning," the official outlet reported, on September 5.

Along with Iran and Saudi Arabia in the Middle East, Vietnam and its Southeast Asian neighbors Malaysia and Singapore are world leaders in executing drug offenders.

MEULEBEKE - Een bewoner uit de Onze-Lieve-Vrouwstraat kreeg de politie over de vloer na een klacht van zijn buren. De man heeft in zijn tuin een paar hennepplanten staan die tot ruim twee meter hoog groeiden.

De schaduw daarvan in de tuin van de buurman was één van de aanleidingen om de politie te alarmeren. 'Bij onze aankomst stelden we meteen vast dat van een cannabisplantage helemaal geen sprake was. Er staan een paar planten, alles samen hooguit een paar vierkante meter, wat helemaal niet illegaal is. Het is perfect toegelaten om in de tuin een paar hennepplanten te kweken voor marihuana voor eigen gebruik', verduidelijkt commissaris Jean-Marie Samyn van de politiezone MIDOW.

'Er wacht de man dan ook geen veroordeling, ook werden de planten niet verwijderd noch vernietigd. Wel werd een proces-verbaal opgesteld, dat is een standaardprocedure omdat het roken van marihuana eventueel kan leiden tot problematisch gebruik bij de betrokkene. Deze klacht is enkel het gevolg van een uit de hand gelopen burenruzie', besluit de commissaris.

Cannabisteelt komt steeds vaker voor in ons land, al vormen de grote commerciële producenten een bedreiging voor de hobbykweker.

Vorige week ontmantelde de lokale politie in Merksplas nog de grootste cannabisplantage die ooit in ons land werd ontdekt. Een beter moment om een onderzoek te publiceren over cannabisteelt in Vlaanderen konden de Gentse professor Tom Decorte van het Instituut voor Sociaal Drugsonderzoek (ISD) en Pascal Tuteleers (Departement Sociaal Agogisch Werk, van de Hogeschool Gent) zich niet indenken.

De studie is gebaseerd op 89 face-to-face-enquêtes en 659 anoniem ingevulde internetenquêtes. De respondenten zijn vooral mensen die nooit meer dan 20 plantjes in één keer oogsten. Als belangrijkste redenen voor hun eigen teelt noemen ze: 'nieuwsgierigheid', 'financiële voordelen', 'verre verplaatsingen vermijden' en 'onvrede met de kwaliteit van de cannabis in Nederlandse coffeeshops'. Winstmotieven kunnen bij sommige kwekers na verloop van tijd belangrijker worden. Toch blijft de kleinschalige productie zonder commerciële motieven een niet onbelangrijk segment van de cannabismarkt. De onderzoekers achten het niet onmogelijk dat er in Vlaanderen tussen de 10.000 en de 15.000 cannabiskwekers zijn.

Een hardere, repressieve aanpak van de sector - zoals in Nederland enkele jaren geleden - heeft volgens Decorte vooral tot gevolg dat de ervaren hobbykwekers het risico niet meer nemen. 'Het gat in de markt dat zij achterlaten, wordt ingepikt door de nieuwe, professionele kwekers die een geldboete of een opsluiting incalculeren als een beroepsrisico. De winsten die met cannabisteelt te rapen vallen, zijn kennelijk zo groot dat ze na hun arrestatie gewoon opnieuw beginnen. Tegelijk krijgt de cannabisbranche een crimineel karakter.
Intimidaties, wapendracht en diefstal hebben hun intrede gedaan.'

Regulering van de markt

De commerciële kwekers zijn vaak ook minder geïnteresseerd in de kwaliteit van het product. Ze schrikken er niet voor terug om chemische voedingssupplementen te gebruiken en gif te sproeien om spint en andere plantenziektes te bestrijden.

Gezien de blijvende grote vraag naar cannabis en het gemak waarmee de plant in onze contreien gekweekt kan worden, zien de auteurs van het boek in een regulering van de markt de aangewezen oplossing om de met cannabis gerelateerde problemen in te dijken. 'De regulering van verkooppunten, productie en aanvoer lijkt ons de meest geschikte manier om de criminaliteit te bannen en de kwaliteit van het product te bevorderen', stelt Decorte. 'In Nederland merkt men overigens stilaan dat ook het gedoogbeleid maar een beperkte houdbaarheidsdatum heeft.'

Dear Friends, INPUD Activists,

'Ibogaine' and 'Discrimination vs Rights' are chosen by INPUD Activists to be the titles of the 2 Users Choice Major sessions for the 19^th IHRC in Barcelona (11-15 May, 2008).

These two titles have a lot of potential and will undoubtedly attract the attention of a substantial part of the 19^th IHRC's attendants.

The sessions will be put together in the next 2 months. I here by call for your input: send me your abstracts on the titles 'Ibogaine' and 'Discrimination vs Rights' and also submit these abstracts to the IHRC abstract submission system.

Apart from sending me abstracts for the 2 Users Choice major sessions I suggest that INPUD activists who submit abstracts for the conference as a whole would also send me their submitted abstracts. Sending me your abstracts enables me to push for User Activist presentations in the bigger conference program as I am, as INPUD representative member of the Executive Program Committee along with our French peer Eric Schneider (INPUD Activist and president of the French National User Organization ASUD).

I want to thank all people who gave input on session issues and titles and also to the INPUD Activists who participated in the final vote for the 2 sessions.

NEEM DEEL AAN HET WERELDDORP VOOR EEN ANDER DRUGBELEID

Op de speciale sessie van de VN Algemene Vergadering in New-York in juni 1998 stippelden de regeringen van de wereld een 10 jarenplan uit om belangrijke en meetbare resultaten voor te leggen in de strijd tegen drugs tegen 2008.

Zo werd er onder andere een strategie ontworpen om de illegale kweek van coca, cannabis en opium tegen 2008 volledig of grotendeels uit te roeien.

De VN-Commisse over verdovende middelen komt in maart 2008 samen in Wenen om de resultaten van deze strategie te bespreken.

De afgelopen 10 jaar is voor iedereen duidelijk geworden dat deze strategie volledig mislukt is, zelfs in de landen die de doelen het hardnekkigst nastreefden. Vraag en aanbod op de drugmarkt stijgen systematisch in heel de wereld, soms zelfs spectaculair zoals in Afghanistan. Ondertussen heeft het drugverbod geleid tot gewelddadige conflicten, schending van mensen- en burgerrechten, criminalisatie en stigmatisatie van hele bevolkingsgroepen, sociale en gezondheidsrampen, zoals de verspreiding van HIV. Het heeft ook geleid tot de stijging van de georganiseerde misdaad.

Het uitroeien van planten is een bedreiging voor de biologische en culturele diversiteit van de planeet. Hennep, cocabladeren en opium hebben veel toepassingen op medisch en voedingsgebied. Het legaal verbouwen van deze planten kan kleinschalige, niet gesubsidiëerde en duurzame landbouw steunen.

Wenen 2008 is de perfecte gelegenheid voor alle burgers die nieuwe oplossingen willen voor het wereldwijde drugprobleem.

In maart 2008 kunnen we de wereld laten zien dat er meer te vrezen valt van het drugverbod dan van een gereguleerd alternatief.

Wij plannen een 3 daags ‘Werelddorp voor een ander drugbeleid” in Wenen tijdens de zitting van de VN commissie. (de definitieve data worden bevestigd in oktober).

Hierbij vragen we je om mee te werken aan een van de volgende activiteiten in dit dorp:

1. Een tentoonstelling over de cultuur en het nuttig gebruik van planten die door VN drugconventies werden verboden.

We rekenen op de aanwezigheid en/of de medewerking van bedrijven die betrokken zijn bij de organisatie van hennepbeurzen in Europa, maar ook aan bedrijven en organisaties die ijveren voor het nuttig en verantwoord gebruik van hennep/cannabis, paddo’s, cocabladeren etc.

2. Een wetenschappelijke conferentie om het huidige drugbeleid te onderwerpen aan een psycho-analyse. Is het drugverbod gebaseerd op een primitief instinct dat zijn nut al lang geleden heeft verloren?

We rekenen op de aanwezigheid van experts (onderzoekers, vertegenwoordigers van getroffen gemeenschappen etc.) die een ander licht kunnen werpen op het waarom van het aanhoudende drugverbod in weerwil van de vele bewijzen die aantonen dat dit verbod een totale mislukking is.

3. Een manifestatie naar het VN gebouw in Wenen: Genezing in plaats van Oorlog

Wij hopen op de aanwezigheid van duizenden activisten, en steun van muzikanten en artiesten.

In 2003 organiseerde ENCOD een gelijkaardige happening tijdens de halftijdse evaluatie van de strategie die in 1998 werd afgesproken.

JOIN THE GLOBAL VILLAGE FOR A DIFFERENT DRUG POLICY

In June 1998, in a Special Session of the United Nations General Assembly held in New York, the governments of the world announced a 10-year strategy to achieve significant and measurable results in the fight against drugs by the year 2008.

Among others, the strategy included the purpose of eliminating or significantly reducing the illicit cultivation of the coca bush, the cannabis plant and the opium poppy by the year 2008.

In March 2008, the United Nations Commission on Narcotic Drugs will meet in Vienna to review the results of the strategy.

In the past ten years, it has become obvious for everybody that this strategy has failed completely, even in the countries that enforced it most strictly. Drug supply and demand are rising systematically throughout the world, sometimes even spectacularly as in the case of Afghanistan. Meanwhile the policy of prohibiting drugs has led to violent conflicts, violation of human and civil rights, criminalisation and stigmatisation of entire populations, social and health disasters such as the spread of HIV, as well as to the increase of organised crime.

To eliminate plants would threaten the biological and cultural diversity of the planet. Hemp, coca leaves and opium have many medicinal, nutritional and other useful applications. The legal cultivation of these plants can support small-scale agriculture that operates without state support and promotes sustainable development.

Vienna 2008 is the perfect opportunity for all those citizens who want new solutions to the global drugs problem.

In Vienna in March 2008, we can show the world there is much more to fear from drug prohibition than from a tolerant alternative.

Our plan is to organise a 3 day "Global Village for a Different Drug Policy" in Vienna during the period in which the UN meeting will be held.(final dates will be confirmed in October).

We would like to invite you to participate in one of the planned events of this village:

1. An exposition on the culture and beneficial use of plants that are prohibited by the UN Drug Conventions.

We hope to count with the presence and/or collaboration of companies involved in the organisation of hemp fairs around Europe, as well as companies and organisations who promote the beneficial and responsible use of hemp/cannabis, mushrooms, coca leaves etc.

2. A scientific conference with the purpose of making a psychoanalysis of current drug policy. Is prohibition based on a primitive instinct that has lost its legitimacy long ago?

We hope to count with the presence of experts (researchers, representatives of affected communities etc.) who can shed some light on the reasons why drug prohibition is continued in spite of the many evidences that prove it to be a total failure.

3. A demonstration to the UN building in Vienna: Cures Not Wars.

We hope to count with the presence of thousands of activists, as well as musicians and artists.

In 2003, ENCOD organised a similar event, during the mid-term evaluation meeting of the 1998 strategy.

Launch of Asian Network of People who Use Drugs (INPUD ASIA)

On August 19, 2007, a group of drugs users from across Asia launched the first regional network for people who use drugs in Asia under the title “International Network of People who Use Drugs (INPUD - ASIA)”. The event was held during the International Congress on AIDS in Asia and the Pacific’s Community Forum at the Sri Lanka Foundation Institute.

INPUD ASIA is chaired by Anan Pun, a founding member of Recovering Nepal, a national network of drug users in Nepal. Mr. Pun, with support from the Asian Harm Reduction Network (AHRN), traveled to Sri Lanka to invite his Asian constituents to unite their efforts at improving the health and social care of people using and recovering from drug dependence by joining the network.

“Through INPUD Asia, drugs user communities in the region will be able to get support for activities such as advocacy and strengthen capacity of drug user representatives. We hope that this network will lead to greater inclusion of drug user communities in the Universal Access framework and improvements in addressing their needs. Ultimately, the Network should lead to positive changes and reduction of vulnerability to HIV among drug users” said Mr. Pun.

Evidence suggests that the Asian epidemic and its growth have been the result of preventable HIV transmission cases among injecting drug users. Out of the 7.4 million recorded people living with HIV in Thailand, Nepal, Indonesia, Myanmar and parts of India, Pakistan and China, more than half inject drugs. An estimated 6.5 million persons currently inject drugs in Asia and in some areas, 89% of new HIV cases are attributable to injection drug use.

Out of the USD 8.3 billion available in 2006 to respond to HIV across the world, its prevention among injecting drug users requires as little as USD 200 million per year. As a matter of common sense, priority in the response should be to curb transmission where it is most rapidly spreading, where there are fewest services to address needs, where those most vulnerable face poverty, prejudice, criminalization, marginalization, stigma and discrimination in a negatively reinforcing relationship, where the very concept of human rights is foreign and alien, both among civil society and in governments, where resources can be invested most effectively, and where national resources are scarce and corruption is institutionalized – among Asian drug users. Yet, the situation of Asian drug users is dire with harm reduction service coverage dropping from 5.4% in 2003 to 3% in 2005.

While injecting drug use remains the most important – and unaddressed – vector for HIV transmission in Asia, drug users are rarely consulted and involved in determining how to meet their own needs. INPUD Asia will therefore provide a strong mechanism for representation and involvement of people using drugs across Asia through advocacy, education and networking.

It is with this in mind that the drug users and their representatives from Nepal and Thailand discussed the urgent need to decriminalize drug users and harmonize drug control and HIV policies. Without such changes in the political and legal environment, it will be near impossible to deliver an effective and comprehensive package of services and respect users’ fundamental right to heath. This in turn led participants to highlight that Universal Access and other national platforms were not comprehensive at present since those systematically have failed in addressing hepatitis C (HCV). High rates of untreated HCV among IDU communities – not HIV or related opportunistic infections – is resulting in the deaths of several injecting drug users in Asia while HCV treatment remains too expensive to even contemplate.

Participants also noted that the focus on injecting instead of simple drug use leads to serious challenges in Asia. Colleagues from Cambodia and Papua New Guinea noted that funding and support to address the widespread use of amphetamine-type stimulants (ATS) and alcohol is almost inexistent. Other colleagues from Indonesia and Sri Lanka also noted that there was an important dirge of drug prevention and treatment services addressing the special needs of girls and women. Finally, participants called for the local generic manufacture of substitution drugs like buprenorphine and methadone – both on WHO’s Essential Drug List since 2005 – and the costly drugs to treat HCV.

Trekt Uw Plant Gaat Door

FREEDOM TO FARM

Op 25 april 2007 werden 5 leden van Trekt Uw Plant veroordeeld door de Correctionele Rechtbank van Antwerpen voor het bezit van een cannabisplantje.

Drie leden kregen starfopschorting, de overige twee kregen een boete van 15 (VIJFTIEN) euro.

Wij hebben hoger beroep aangespannen tegen deze veroordeling. Deze veroordeling staat haaks op de ministeriële richtlijn van januari 2005. Die richtlijn stelt immers dat het bezit van 1 plantje, mits geen sprake is van verzwarende omstandigheden, niet vervolgd zal worden.

De zaak zal eind 2007/begin 2008 voorkomen. Onze advocaat zal zich richten op de juridische argumenten. Het negeren van de ministeriële richtlijn door het Antwerps parket en de correctionele rechtbank doet afbreuk aan de rechtszekerheid waar iedere burger recht op heeft: men moet duidelijk weten wat mag en niet mag. We zullen daarbij ook het Europees Verdrag van de Mensenrechten inroepen, waarin het begrip "rechtszekerheid" wordt omschreven.

En ondertussen, in de politiek...

Onze inschatting is dat de nieuwe oranjeblauwe regering, als die eenmaal geïnstalleerd is, haar voornemen bekend zal maken om de ministeriële richtlijn te vervangen door een wet waarin het bezit van een cannabisplant opnieuw volledig strafbaar wordt gesteld, terwijl het bezit van enkele grammen cannabis waarschijnlijk een "lage vervolgingprioriteit" zal behouden.

Naast de rechtszaak moeten we dus ook het politieke debat blijven voeden. Het model van de collectieve teelt voor eigen gebruik biedt een oplossing voor het probleem van de illegale cannabisteelt, het coffeeshoptoerisme, de uitgaven aan politionele en justitiele acties tegen cannabis etc.. We hebben genoeg argumenten om dit model te verdedigen.

Voor het einde van het jaar plannen we nieuwe acties, volg deze site voor meer nieuws..
